GENERAL TERMS AND CONDITIONS OF SALE - IBIZA DESIGN OUTDOOR S.L.

1- IDENTIFICATION AND COMMERCIAL STRUCTURE

This website and the logistical operations are managed by the company IBIZA DESIGN OUTDOOR S.L., registered in the Mercantile Registry of IBIZA (BALEARIC ISLANDS).

  • Registered Office: Avda de Sant Joan de Labritja, Num 15, 07800 Eivissa (Illes Balears), Spain.

  • Logistics Operations Center: Vila-Sacra, Girona (Spain).

  • Commercialization and Distribution in Andorra: Commercial promotion and distribution within the Andorran territory are ensured by the entity EPA Group (Andorra).

  • Contractual Relationship: Notwithstanding the commercial intermediation of EPA Group, the contractual sales relationship, invoicing, and after-sales service (ASS) are established exclusively with IBIZA DESIGN OUTDOOR S.L.

2- ORDERS AND PRODUCTS

All items sold by IBIZA DESIGN OUTDOOR S.L. are new. Technical characteristics are those provided by the manufacturer. Photographs are not contractually binding.

3- PRICES AND PAYMENT METHODS

The prices of our products are indicated in Euros Excluding Taxes (Net / EX-VAT).

  • Taxes: Value Added Tax (VAT), IGI, or any applicable local tax shall be applied according to the regulations in force in the country of destination of the goods.

  • Accepted Payment Methods:

    • Credit/Debit Card: Secure payment through the BANCO SABADELL system.

    • Bank Transfer: The order will be processed upon final receipt of funds in our account.

4- RETENTION OF TITLE AND LEGAL RECOURSE

IBIZA DESIGN OUTDOOR S.L. retains full ownership of the goods sold until the effective and full payment of the total sale price, including costs and taxes.

  • In the event of failure to pay in full by the agreed due date, the company reserves the right to repossess the goods at the customer's expense.

  • In the event of a payment dispute, the company reserves the right to initiate all necessary legal actions before the competent courts to recover the debt, as well as any late payment interest and potential legal costs.

5- DELIVERY AND VERIFICATION UPON UNPACKING

Delivery is made by appointment. To avoid any subsequent dispute, the following rules apply strictly:

  • Mandatory Unpacking Verification: The customer must unpack the goods in the presence of the carrier to check their condition.

  • Rejection for Damages: If any breakage, dents, or defects due to transport are observed during unpacking, the customer must refuse the package and write on the delivery note: "Refused due to transport damage".

  • Validation of Receipt: Signing the delivery note without specific reservations regarding the condition of the unpacked product implies acceptance of the item in perfect condition. No claim regarding the condition of the product will be accepted once the carrier has left.

6- RIGHT OF WITHDRAWAL AND RETURNS (SPANISH LAW)

In accordance with Spanish legislation:

  • Period: The customer has 14 calendar days from receipt to exercise their right of withdrawal.

  • Return Costs: Return shipping costs are the sole responsibility of the customer and are fixed at 10% of the net value (EX-VAT) of the returned goods.

  • Condition: The product must be returned in its original packaging, complete, and in perfect condition for resale.

7- REFUNDS AND WARRANTY

Refunds will be issued within 14 days following inspection at our warehouse in Vila-Sacra. Products come with a 3-year legal warranty against manufacturing defects. Natural wear and tear or incorrect assembly are not covered.

8- APPLICABLE LAW AND JURISDICTION

These conditions are governed by Spanish law.

  • Jurisdictional Competence: In the event of a dispute, the Spanish courts shall have sole jurisdiction for any matter occurring outside the Andorran territory.

  • For specific distribution activities operated by EPA Group within the territory of the Principality of Andorra, the competent jurisdiction may be determined according to local distribution agreements.
