Terms of Sales
1- REQUEST IBIZA DESIGN, registered in the Commercial Register of GIRONA Address: IBIZA DESIGN Avda de Sant Joan de Labritja, Num 15 07800 EIVISSA - (ILLES BALEARS) SPAIN Hereinafter referred to as "the company IBIZA DESIGN."
2- ORDERS
All items sold by IBIZA DESIGN are new, and the technical description of the products corresponds to that of the manufacturer. The photos are not contractual.
The customer places their order by following the process in effect on the website and confirms the detailed summary. The customer must provide all necessary delivery information: address, access code, floor... (and, for example, in the case of items subject to special delivery conditions, the phone number where they can be reached during the day to arrange an appointment).
For the first order and/or during registration, the customer must enter their first name, last name, email address (username), and password. The password is strictly personal.
During each visit, to access personal data or place an order, the customer will be previously identified by their username and password, which is not used to make a payment. The information recorded by IBIZA DESIGN's system is considered proof of transactions concluded between IBIZA DESIGN and its customers. The contractual information is presented in French and will be confirmed at the latest upon delivery. IBIZA DESIGN reserves the right to cancel or refuse any order from a customer with whom there is a dispute related to the payment of a previous order. IBIZA DESIGN acknowledges receipt of the order by displaying the order number and sending an email with this detail. The customer's order will only be considered accepted after validation by IBIZA DESIGN. Some orders may require additional requests from the customer. In this case, the customer will be informed by email of the supporting documents to be sent to obtain the final validation of their order. IBIZA DESIGN reserves the right to cancel the order if these supporting documents are not received or if the documents received are deemed non-compliant. The customer will be informed by IBIZA DESIGN.
3- PRICES
Prices are stated in euros, including all taxes but excluding delivery (TTC). Products are supplied at the price in effect on the date of the order.
The customer can pay for purchases using the following payment methods:
Online by credit card at the time of order (Carte Bleue, Visa, Mastercard)
By credit card over the phone at 0034 872 213 931 (local call cost)
By bank transfer; in this case, the customer will receive an email with our bank details (RIB) to proceed with the transfer
IBIZA DESIGN makes every effort to ensure the confidentiality and security of data transmitted on its website. In this regard, banking data is managed by BANCO SABADELL, which uses a secure SSL encryption module.
4- DELIVERY
The delivery costs and times are indicated to the customer either on the website or by a company employee in-store.
- 4.1- Delivery Time IBIZA DESIGN undertakes to do everything possible to meet the deadlines indicated on the product sheets and to use all possible means to inform the customer of any delays. For all products available in stock on the day of the order, the average shipping time is 7 working days, and the delivery time is 14 working days after shipment. Delivery is made by appointment with the carrier, scheduled within 5 days of the order. For all other products, IBIZA DESIGN undertakes to deliver the customer as soon as possible. This is the time required by the manufacturer to produce your product, which is an average and usual period; IBIZA DESIGN cannot be held responsible if the manufacturer is delayed in production.
- 4.2- Receiving the Order The delivery of products to the customer is carried out:
Either by making the products available to the customer in-store, materialized by the customer signing a release form, in which case the customer bears the transport costs and risks (you have 10 days to collect your order by presenting ID and your order form)
Or by delivery at the customer's expense to the location specified by them (which must necessarily be within the geographic area indicated on the website and in-store) by a carrier mandated by the company, who then bears the transport risks.
Delivery is confirmed by the customer's signature on the delivery note.
Upon receipt of the delivery, the customer or recipient of the products must be able to prove their identity upon request. The customer undertakes, after opening and checking the contents of the package(s) in the presence of the carrier, to sign the delivery receipt presented by the driver.
In case of any issues, the customer must make all necessary reservations on the acknowledgment sheet, have the delivery note signed by the driver, and retain a copy of the document.
In case of transport damage, the customer must refuse the damaged product to the driver and indicate "Refused due to damage" on the acknowledgment sheet, failing which any recourse against the latter would be impossible.
By signing the delivery receipt without specific reservations and accepting the products, the customer acknowledges having received the goods in satisfactory condition. Consequently, any claim related to the condition of the delivered products cannot be accepted.
In case of non-compliance with the order in terms of quality or quantity, the customer must inform IBIZA DESIGN’s Customer Service, indicating the order reference by email: lavillagardendesign@gmail.com.
Before delivery, the customer undertakes to check the product dimensions to ensure it can be accessed and installed at home without complications. IBIZA DESIGN cannot be held responsible for a delivery that cannot be made due to "incompatible" dimensions, and the delivery costs will remain the responsibility of the customer.
5- FORCE MAJEURE
Unforeseeable events (such as strikes, machine breakdowns, supply difficulties, fires...), as well as any event beyond IBIZA DESIGN’s control that prevents, in whole or in part, either production, supply, or transport of the goods mentioned in the order, are deemed to make the order unenforceable. IBIZA DESIGN will inform the buyer in due time of such events. The quantities ready for delivery at the time of the event must be accepted by the customer.
6-CANCEL MY ORDER OR RETURN AN ITEM PURCHASED ONLINE
To request a cancellation or return from a Marketplace seller, access your customer account to follow the steps related to your order.
Do you want to cancel your order? Select "Cancellation." We will process your request as soon as possible.
Do you wish to return an item? Choose "Withdrawal" and the corresponding item. We will inform you of the return conditions.
Attention! You have 14 days from the delivery date to request a return. This period varies depending on distance selling regulations. Return shipping costs are the responsibility of the customer, amounting to 10% of the order value. It is also possible to drop it off at a physical IBIZA DESIGN store. The order must be returned in its original packaging.
7-REFUND OF MY ONLINE ORDER
We reserve a period of 14 days to refund you, starting from:
- The date of the claim made from your customer account
- The date you returned the product, provided you did so.
The refund will be processed after the item is received in our warehouse. The refund will be made using the same payment method you used for your purchase. You will then receive a refund confirmation by email. Don't forget to check your spam folder... the email might be there!
The simple cancellation of an order before delivery is not included in the withdrawal period. The customer must inform IBIZA DESIGN as soon as possible.
Non-refundable:
- Transaction fees, if applicable
- Optional deliveries (specialized €70 or replacement €105) if the order is already in shipment
- Return costs if the customer refuses the goods for any reason, approximately €50 per package (estimate on request)
8-WARRANTY
Items sold by IBIZA DESIGN are guaranteed new. Items from the general range are not intended for professional use, and professional use would void the product warranty. The products offered comply with current French legislation and applicable Spanish standards. Therefore, IBIZA DESIGN cannot be held responsible.
Defects and deterioration caused by natural wear and tear or external accidents (abnormal use, fire, incorrect assembly, defective maintenance, water damage, etc.) or by product modification not foreseen or specified by the seller are excluded from the warranty.
The product warranty corresponds to the "Manufacturer's Warranty." To benefit from this warranty, the product must be returned in perfect cleanliness, free of any stains, and accompanied by the invoice. Under this warranty, IBIZA DESIGN commits to replacing or repairing the product or component recognized as defective by its services free of charge.
9-RETENTION OF TITLE IBIZA DESIGN
retains full ownership of the goods sold until the actual payment of the full sale price and any applicable late interest.
10-INTELLECTUAL PROPERTY
All texts, comments, works, illustrations, and images reproduced on IBIZA DESIGN are reserved under copyright and intellectual property rights worldwide. As such and in accordance with the Intellectual Property Code, only private use is authorized, subject to different or more restrictive provisions of the intellectual property code.
Any total or partial reproduction of the IBIZA DESIGN site is strictly prohibited.
11-APPLICABLE LAW AND DISPUTES
- These general sales conditions are subject to Spanish law. Any commercial dispute between IBIZA DESIGN and the buyer is subject to the jurisdiction of Spanish courts.
- It is expressly agreed that in the event of a dispute, the Spanish court will be the sole competent authority.
