Hereinafter referred to as "La Villa Garden&Design company".

2- ORDERS
All items sold by La Villa Garden&Design are new, and the technical description of the products corresponds to that of the manufacturer. Photos are not contractual.

The customer places their order following the process in force on the site and confirms the detailed summary of it. The customer must provide all necessary information for delivery: address, access code, floor… (and, for example, in the case of items with special delivery conditions, the phone number at which they can be reached during the day for scheduling an appointment).

For the first order and/or during their registration, the Customer must enter their first name, last name, email address (username) and password. The password is strictly personal.

During each visit, when accessing personal data or placing an order, the customer will have been previously identified by their username and password, it being specified that this does not serve to make a payment. The information recorded by La Villa Garden&Design's system is considered as proof of the transactions concluded between La Villa Garden&Design and its customers. The contractual information is presented in French and will be confirmed with these contractual details at the latest at the time of delivery. La Villa Garden&Design reserves the right to cancel or refuse any order from a customer with whom there is a dispute regarding the payment of a previous order. La Villa Garden&Design acknowledges receipt of the order to the customer by displaying the order number and by sending an email with this detail. The customer's order will be considered accepted only after its validation by La Villa Garden&Design. Some orders may require additional requests to the Customer. In this case, the Customer is notified by email of the supporting documents to be sent in order to obtain the final validation of their order. La Villa Garden&Design reserves the right to cancel the order if these supporting documents are not received or if the documents received are deemed non-compliant. The customer will be informed of this by La Villa Garden&Design.

3- PRICES
Prices are stipulated in euros, all taxes included except delivery (TTC). Products are supplied at the price in effect on the date the order is placed.

The Customer can pay for their purchases using the following payment methods:
• Online by credit card at the time of ordering (Carte Bleue, Visa, Mastercard)
• By CB over the phone at 0034 872 213 931 (cost of a local call)
• By bank transfer; in this case, the Customer will receive an email with our bank details (RIB) to proceed with the transfer
• By Paypal
• By Bizum

La Villa Garden&Design company makes every effort to ensure the confidentiality and security of data transmitted on its site. In this regard, banking data is managed by BANCO SABADELL service, which uses a secure SSL encryption module.

4- DELIVERY
Delivery costs and times are indicated to the Customer either on the website or by an employee of the Company in the store.

• 4.1-Delivery time
La Villa Garden&Design company commits to do everything possible to respect the deadlines indicated on the product sheets and to use all possible means to inform the customer of any possible delays. For all products available in stock on the day of the order, the average shipping time is 7 working days, and the delivery time is 14 working days after shipment. Delivery is made by appointment agreed upon with the carrier; the appointment is made within 5 days following the order. For all other products, La Villa Garden&Design commits to deliver the customer in the best possible time. This is the time required for the manufacturer to produce your product, it is an average and usual delay, La Villa Garden&Design cannot be held responsible if the manufacturer is delayed in production.

• 4.2-Receiving the order
Delivery of products to the customer is carried out:

either by making the products available to the Customer in-store, evidenced by the Customer signing a departure slip, in which case the Customer then bears the costs and risks of transport (you have 10 days to pick up your order by presenting an ID and your order form)
or by delivery to the customer's expense and to the location indicated by them (which must necessarily be located in the geographical area indicated on the website and in-store) by a carrier commissioned by the Company, which then bears the risks of transport.
Delivery is evidenced by the Customer signing a delivery slip.
When receiving the delivery, the customer or recipient of the products must be able to, if requested, prove their identity. The customer undertakes, after opening and checking the contents of the package(s) in the presence of the carrier, to sign the delivery receipt presented by the driver.

In case of a problem, the customer will make all corresponding reservations to the observations noted on the signing sheet, the delivery slip, have the driver sign it, and keep a copy of the document.

In the event of transport damage, the customer must refuse the damaged product to the driver and indicate "Refused due to damage" on the signing sheet, otherwise, any recourse against the latter would be impossible.

By signing the delivery receipt without specific reservations, and accepting the products, the customer acknowledges having received the merchandise in a state giving them complete satisfaction. Therefore, any claim related to the condition of the delivered products cannot be received.

In case of delivery not conforming to the order in quality or quantity, the Customer must inform La Villa Garden&Design's Customer Service by indicating the order reference by email: lavillagardendesign@gmail.com

Before any delivery, the customer undertakes to check the dimensions of the product to ensure that it can access and be installed at their home without complication. La Villa Garden&Design cannot in any case be held responsible for a delivery that cannot be completed due to "incompatible" dimensions, the delivery costs remaining at the Customer's expense.

Deliveries are understood to mean depositing the articles on the ground floor (unless otherwise indicated on the order). If the carrier has passed without notifying the customer beforehand, a second appointment will be possible without additional costs.

Simple deliveries are made by express courier without an appointment during the day from Monday to Friday (this may vary depending on the agency). Specialized deliveries are made with an appointment from Tuesday to Friday (this may vary depending on the agency). Deliveries with recovery are made during the day from Monday to Friday with an appointment (the recovery must be pre-packaged).

Special case:
Any delivery requiring an additional delivery person (high floor, no elevator, heavy weight, installation and removal of old bedding, etc…) will incur specific costs that must be paid by the customer when placing the order. Under no circumstances can the customer claim them at the time of delivery.

5- FORCE MAJEURE
Cases of force majeure are unpredictable events (such as strikes, machine breakdowns, supply difficulties, fire...), as well as any event beyond the control of La Villa Garden&Design company and hindering, in whole or in part, either the production or the supply or the transport of the goods mentioned in the order, are deemed to render the order unexecutable. La Villa Garden&Design company will keep the buyer informed in a timely manner of the events listed above: the quantities ready to be delivered at the time of the event must be accepted by the customer.

6-CANCEL MY ORDER OR RETURN AN ITEM PURCHASED ONLINE
To make a cancellation or return request to a Marketplace seller, access your customer account to follow the steps related to your order.

We will process your request as soon as possible.

Do you wish to return an item?
Choose "Withdrawal" and the corresponding item.
We will inform you about the return conditions.

Attention! You have 14 days from delivery to request a return.
This period varies according to the distance selling regulations.

7-REFUND OF MY ONLINE ORDER
We reserve a period of 14 days to refund you, starting from:

the date of the claim made from your customer account
the date you returned the product, provided you have done so.
The refund will be made after receiving the item in our warehouses.
The refund will be made using the same payment method you used for your purchase.
Then, you will receive a refund confirmation by email.
Don't forget to check your spam folder... the email might be there!
Simple cancellation of an order before delivery is not included in the withdrawal period.
The customer must inform La Villa Garden&Design as soon as possible.
Not refunded:

transaction fees, if any
Optional deliveries (specialized 70€ or replacement 105€) if the order is already in shipment
return costs if the customer refuses the merchandise for any reason, approximately 50€ per package (quote on request)

8-WARRANTY
The items sold by La Villa Garden&Design are guaranteed new.

Items in the general range are not intended for professionals, and professional use would void the product warranty.
The products offered comply with current French legislation and applicable standards in Spain. Therefore, La Villa Garden&Design cannot be held responsible.

Defects and deterioration caused by natural wear and tear or by an external accident (abnormal use, fire, incorrect assembly, defective maintenance, water damage...) or by a modification of the product not foreseen or specified by the seller, are excluded from the warranty.
The warranty of the products corresponds to the "Manufacturer's Warranty."
To benefit from this warranty, the product must be returned in perfect cleanliness, free of any stains, and accompanied by the invoice. In execution of this warranty, La Villa Garden&Design commits to replacing or repairing the product or component recognized as defective by its services for free.

9-RETENTION OF TITLE
La Villa Garden&Design reserves full ownership of the goods sold until the effective payment of the entire sale price and any late interest.

10-INTELLECTUAL PROPERTY
All texts, comments, works, illustrations, and images reproduced on La Villa Garden&Design are reserved under copyright and intellectual property for the whole world.

As such, and in accordance with the Intellectual Property Code, only the use for private purposes is authorized, subject to different, or more restrictive provisions of the intellectual property code.

Any total or partial reproduction of the La Villa Garden&Design site is strictly prohibited.

11-APPLICABLE LAW AND DISPUTES
1.These General Terms and Conditions of Sale are subject to Spanish law. Any commercial dispute between La Villa Garden&Design and the Buyer is subject to the jurisdiction of the courts of Spain.

2.It is expressly agreed that, in the event of any dispute, the Spanish court will be the only competent authority.
